1. No Offer to Sell a Franchise
This Site is informational only. It is not an offer to sell, or a solicitation of an offer to buy, a franchise.
A franchise offer is made only by a Franchise Disclosure Document (“FDD”) delivered in compliance with applicable federal and state law. Certain states require registration or exemption before a franchise may be offered or sold in that state. We do not offer franchises to residents of any jurisdiction where the offering is not registered or exempt.
Nothing on this Site creates a franchise relationship, a contract, or any obligation on either party.
2. No Financial Performance Representation
Any financial figures shown on this Site or in materials we provide are estimates based on the operations of Palm Berries corporate-owned locations. They are not a guarantee, representation, or projection of results any franchisee will achieve.
Individual results vary based on location, market conditions, operator experience, and other factors outside our control. Past performance does not guarantee future results. Refer to Item 7 and Item 19 of our FDD for the complete investment range and any financial performance representations.
3. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use this Site or submit an inquiry.
4. Submitting an Inquiry
When you submit a franchise inquiry, you agree that the information you provide is accurate and complete. Submitting an inquiry does not obligate us to award you a franchise, and we may decline any inquiry at our sole discretion for any lawful reason.

By submitting an inquiry, you consent to receive email from us about your application.

6. Intellectual Property
All content on the Site — text, graphics, logos, images, and the Palm Berries name and marks — is owned by or licensed to Palm Berries and protected by intellectual property law. You may view and print pages for your personal, non-commercial use in evaluating a franchise opportunity. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.
7. Confidential Materials
Materials we provide during the franchise development process — including brochures, presentations, unit economics, and the FDD — are provided for your evaluation only. You agree not to disclose them to competitors or use them for any purpose other than evaluating a Palm Berries franchise.
8. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information
- Use the Site for any unlawful purpose
- Attempt to gain unauthorized access to the Site or its systems
- Use automated tools to scrape, harvest, or collect data from the Site
- Interfere with or disrupt the Site
9. Third-Party Links
The Site may link to third-party websites. We do not control and are not responsible for their content, policies, or practices.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Lincoln County, North Carolina, and you consent to their jurisdiction.
Nothing in this section limits any right you may have under applicable state franchise law.
14. Changes to These Terms
We may revise these Terms at any time. The revised version takes effect when posted, and the “Last updated” date will change. Continued use of the Site after changes are posted means you accept them.
